Certain areas of this website are restricted from being accessed by you. ThaiTanium Performance may further restrict access to you at any time, in absolute discretion. Any user ID or password for this website are confidential and require confidentiality from you as well.

In these Standard Terms and Conditions, “Your Content” is defined as any audio, video, text, images, or other material you choose to display on this website. By displaying your content, you grant ThaiTanium Performance a non-exclusive, worldwide irrevocable, sub licensable license to use, reproduce, adapt, publish, translate, or distribute any and all media. Your content must be your own and must not invade any third-party’s rights. ThaiTanium Performance reserves the right to remove any of your content from this website at any time without notice.
5. Warranties:
All products are warrantied to be free from defect of material and workmanship prior to sale by their manufacturer. We do not warranty the products in anyway. Any alteration to the product or improper use as specified by us, occurrence of, or circumstances arising from, any incident after purchase is null and void. Warranties will vary from product to product. It is our responsibility to make you aware of warranty terms and conditions. We will provide you with such processes and information regarding end-user warranty fulfillment and product warranty terms.
6. Limitation of liability:
In no event shall ThaiTanium Performance or any of its officers, directors, and employees be held liable for any situation connected with your use of this website and whether such liability is under contract. ThaiTanium Performance, including its officers, directors, and employees shall not be held liable for any indirect, consequential, or special liability arising out of or in any way related to your use of this website. Any work done with titanium material is at your own risk! ThaiTanium Performance takes safety very seriously. Titanium is known for its reactivity towards oxygen and nitrogen at elevated temperatures. Please take care while working with titanium in any extreme conditions and be mindful of sharp edges and metal shavings that can cause a potential fire hazard. ThaiTanium Performance is not liable for any property damage or injury. Please familiarize yourself with titanium and take precautions before welding. If you do not have the correct tools or materials, please consult a professional to do the work. Please operate your vehicle at all times in a safe manner. In no case will the seller be held liable for any property damage, personal injury and/or death that may occur in the event that the Buyer operates their vehicle in an unsafe manner or violates any law. Do not use the streamlined exhaust products unless and until you the Buyer have carefully read this customer notification and disclaimer of liability. Be sure to abide by all local, state and federal laws, including but not limited to emissions, vehicle inspections, vehicle safety standards, and traffic laws. It is your responsibility to know what those laws are and how they apply to you. The installation of these products on your vehicle indicates that you have (a) had the opportunity to inquire about applicable local, state and federal laws and (b) read, understand, and accept all of the terms of, this Disclaimer. The streamlined exhaust products are designed and intended solely for legally-organized and sanctioned closed- course off-road competition use and is not for use on public streets, roads or highways. This product is capable of disabling the emissions system on some vehicles. Emission delete products are for the above-mentioned uses only—or where emissions equipment is not required by law. Use on public streets, roads or highways is a violation of federal and certain state (including California) and local environmental laws. Your vehicle will not pass emissions testing if the emissions system has been disabled. Please check your local, state and federal laws to determine if you are within your rights to modify your vehicle’s emissions system. The seller hereby disclaims any representation or warranty, expressed or implied. Use of this product will not comply with local, state, or federal emission levels, noise levels or safety standards. Furthermore, if the emissions system on your vehicle is disabled, the seller hereby expressively warns you that use of the vehicle on public streets, roads and highways (or for any use other than legally-organized and sanctioned, closed- course, off-road competition use) is illegal. The buyer assumes all responsibility for such use and legal compliance.
7. Indemnification:
You hereby indemnify to the fullest extent ThaiTanium Performance from any and all liabilities, costs, demands, causes of action, damages and expenses arising in any way related to your breach of any of the provisions of these terms.
8. Sever-ability:
If any provision of these terms is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein.
9. Variation of Terms:
ThaiTanium Performance is permitted to revise these terms at any time as we see fit, and by using this website you are expected to review these terms on a regular basis.
10. Assignment:
ThaiTanium Performance is allowed to assign, transfer, and subcontract its rights and/or obligations under these terms without any notification. However, you are not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these terms.
11. Entire Agreement:
These terms constitute the entire agreement between ThaiTanium Performance and you in relation to your use of this website. This supersedes all prior agreements and understandings.
12. Group Buy Agreement:
By participating in a group buy, you are acknowledging your understanding that it may take up to 3-6 months to deliver products to your door. ThaiTanium Performance reserves the right to decline an entire group buy if we see fit. Declines include but are not limited to: poor communication, amount agreed on is not paid within the proper time frame or if lead times are not acknowledged. You must make a 45% deposit of your total cost to hold your position in the group buy. This must be paid upon placement of your order, once your bulk materials are completed and ready to ship. You will be required to pay the remaining 50% prior to shipping (we will notify you). Upon arrival at our shop location materials will then be welded and then shipped to you. Invoices, picture updates and tracking numbers will be forwarded to you. ThaiTanium Performance requires at least five individuals to participate in a group buy for us to begin production. To be clear if an individual so decides to withdraw themselves from the group buy the 50% deposit is non-refundable.
13. Governing Law & Jurisdiction:
These terms will be governed by and interpreted in accordance with the laws of the state of Illinois, and you submit to the non-exclusive jurisdiction of the state and federal courts located in Illinois for the resolution of any disputes.
14. Website Errors:
In the event that a ThaiTanium Performance product is mistakenly listed at an incorrect price, ThaiTanium Performance reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. ThaiTanium Performance reserves the right to refuse or cancel any such orders whether or not the order has been confirmed. If your credit card has already been charged for the purchase and your order is cancelled by us, ThaiTanium Performance shall issue a refund to your credit card account in the amount of the incorrect price.
15. Third-Party Links:
In an attempt to provide increased value to our visitors, ThaiTanium Performance may provide a link to websites operated by third parties. However, even if the third party is affiliated with ThaiTanium Performance, we have no control over these linked sites, all of which have separate privacy and data collection practices, independent of ThaiTanium Performance. These linked sites are only for your convenience and therefore can access them at your own risk. ThaiTanium Performance seeks to protect the integrity of its web site and the links placed upon it and therefore requests any feedback on not only its own site, but for sites it links to as well (including if a specific link does not work).
16. Returns:
Any or all items that you the customer, decides to return must be sent to the address in the contact us page prepaid. They must be in original packaging. We are not liable for paying the shipping fee on return items. Buyer must also fill our return form, please contact us for a return form before any items are sent back. We can accept returns up to 25 days after purchase in exchange for store credit. If a full return is requested, a 20% restocking fee will be charged. If you placed a deposit on a group buy it is non-refundable, furthermore after receiving the group buy products, they are non-exchangeable nor refundable there are no exceptions. The group buy is a special agreement, therefore ThaiTanium Performance cannot accept a return or exchange.
17. Shipping:
Shipping carrier may vary, it will be chosen based on material weight and size. When checking out you will see one shipping option, so please note this may not be the primary carrier chosen. All prices will remain the same no matter what carrier company is chosen for any specific parts. If there is a price change with any of the carriers we've selected, we will refund the money owed. Expedited shipping is available upon request and needs to be arranged with us, as additional charges may apply. Please note that purchases made in the State of Illinois are subject to state sales tax. All orders are shipped ground freight unless otherwise specified. Shipping information will be provided to you once your product has been packaged and shipped.
18. Miscellaneous:
Due to being a small company the owner currently works full time and is very limited during the day. However, ThaiTanium Performance will fulfill orders quickly and ship them within a reasonable amount of time. So please be patient when making or inquiring about products.
